Terms of purchase and use of the Freedman online store
1. Introduction
This document, together with every document referred to in it, sets out the terms governing the use of www.freedman.gr and the purchase of products through this website (the “Terms”). Please read these Terms carefully before using the website. By using it or placing an order, you agree to be bound by these Terms and the Cookies and Privacy Policy published on our website. If you do not agree, you must not use this website. These Terms may be amended. It is your responsibility to read them regularly before making purchases.
2. Website operator and contact details
This website is operated by FREEDMAN ΜΠΑΚΑΒΟΣ ΧΡΗΣΤΟΣ ΒΙΟΤΕΧΝΙΑ ΕΝΔΥΜΑΤΩΝ (FREEDMAN CHRISTOS BAKAVOS CLOTHING MANUFACTURER), VAT number 119764992, GEMI number 114525405000, Tax Office Thessaloniki A, registered office: 92 Monastiriou Street, Thessaloniki, 54627, Greece (“Freedman”). For enquiries about www.freedman.gr, visitors/users may contact the company at info@freedman.gr, by post at the above address, through the contact form or by telephone on +30 2310 518734, Monday–Friday, 10:00–17:00.
3. Information and personal details
The information and personal details you provide are processed under these Terms. By using this website, you consent to the processing of that information and declare that all information and details you provide are true and accurate.
4. Use of the website
When using this website or placing an order, you undertake to provide your email address, postal address and other contact details correctly and accurately. Fraudulent or false orders and the use or transmission of details you do not lawfully hold are prohibited. If we reasonably believe that such an order has been placed or that the details do not belong to you, we may cancel your purchase and inform the competent authorities. Use the website only for legitimate enquiries and orders. Freedman may use the information you provide to contact you where necessary. Without all required information, we cannot process your order. By placing an order, you warrant that you are at least 18 and legally capable of entering into binding contracts.
5. Availability of services
All orders are subject to product availability. In the event of supply difficulties or products being out of stock, we reserve the right to inform you about similar products of equal or higher quality and value that you may order. If you do not wish to order those alternatives, we will refund any amount paid in full. Products offered through this website are available in Greece. Orders from another EU member state are welcome, but delivery carries an additional shipping charge disclosed before purchase.
6. Ordering and formation of the contract
If we do not accept your order and money has already been debited, it will be refunded in full. To order, follow the purchase process and click “Authorise Payment”. You will then receive an email acknowledging receipt of your order (“Order Confirmation”). This does not mean acceptance: your order is an offer to purchase one or more products. All orders are subject to our acceptance, confirmed by an email stating that the product has been dispatched (“Dispatch Confirmation”). The purchase contract between us (“Contract”) is formed only when we send the Dispatch Confirmation and covers only the products whose dispatch it confirms. We are not obliged to supply other products in your order until their dispatch is confirmed separately.
7. Rejection of orders
We reserve the right at any time to withdraw products from this website or remove or edit its material or content. Although we make every effort to process all orders, exceptional circumstances may require rejection after an Order Confirmation has been sent. We reserve the right to do so at our sole discretion. We accept no liability to you or any third party for withdrawing products, removing or editing website material or refusing to process or accept an order after sending an Order Confirmation.
8. Delivery
Subject to clause 5 on availability and exceptional circumstances, we will make every effort to complete your order by the date stated in the Dispatch Confirmation or, if none is stated, within the estimated period shown when choosing a payment method. Delays may arise from customisation, the delivery area or unforeseen circumstances. If we cannot meet the delivery date, we will inform you and offer either a new date or cancellation with a full refund.
Delivery occurs when you or a third party designated by you, other than the carrier, obtains physical possession or control of the products, evidenced by signing the delivery receipt at the agreed address. If delivery is impossible, we will try to find a safe place for your parcel and leave a note explaining where it is and how to collect it. If you are absent at the agreed time, contact us to arrange another day. If an order remains undelivered for 10 days after becoming available for delivery for reasons not attributable to us, we will consider the purchase cancelled and refund all payments, including delivery charges, as soon as possible using the original payment method. Additional transport costs arising from this situation may be higher, and we may charge them to you.
9. Risk and ownership
Responsibility for products passes to you when you or your designated third party, other than the carrier, obtains physical possession or control. Ownership passes upon our receipt of all amounts due for the products, including shipping costs.
10. Prices and shipping costs
Product prices are those shown on the website at the relevant time, except in cases of obvious error. We seek to ensure accuracy, but errors may occur. If we find a pricing error in a product you ordered, we will inform you as soon as possible and allow you to reconfirm at the corrected price or cancel. If we cannot contact you, the order will be treated as cancelled and all amounts paid refunded. We are not obliged to supply a product at an incorrect lower price, even after Dispatch Confirmation, if the error is obvious, unmistakable and could reasonably be recognised by you.
Website prices include VAT but exclude shipping, which is added to the total and disclosed before purchase. Prices may change at any time; subject to the above provisions, changes do not affect orders for which Order Confirmation has already been sent. After selecting products and adding them to your bag, proceed to order and payment by following the purchase steps and completing or checking the information requested. You may change order details before payment. Shipping costs depend on the delivery location and are always disclosed before completion. Registered users can find their order history under “My Account”.
11. Payment methods
Payment by card
Payment may be made with Visa, Mastercard and American Express debit or credit cards. Card details are encrypted to minimise unauthorised access. Your card is charged upon confirmation of your order. By clicking “Authorise Payment”, you confirm that the card belongs to you. If the issuer does not approve payment, we are not responsible for delay or non-delivery and cannot complete your order. Subject to these Terms, refunds for card payments are made only to the same card. Clicking “Authorise Payment” makes the order binding and obliges you to pay. Card validity and authorisation are checked by the relevant payment provider.
Cash on delivery
This method is available for purchases not exceeding €500. On delivery, you must have the exact total in cash as stated in the Dispatch Confirmation email. The courier cannot provide change or accept cheques. For a refund, you must nominate a bank account you hold in the country where the order was placed and provide evidence that you are its lawful beneficiary. An additional charge applies, depending on the courier, and is disclosed before purchase.
Transactions through www.freedman.gr are governed by international and European law on electronic commerce and Greek Consumer Protection Law 2251/1994 on distance selling. Conduct contrary to applicable law, including criminal-law provisions on fraud and corruption, is not tolerated. If Freedman becomes aware of such conduct, it may take lawful action before the competent prosecuting and anti-fraud/corruption authorities, reserving its right to claim compensation for losses and lost profits.
12. Guest and registered purchases
The website permits guest checkout, requiring only the details needed to process the order. Once the purchase is complete, you may register or continue without registering. Registration or login requires full name, mailing address, contact telephone and email. These details remain confidential. Freedman reserves the right to use them to send updates, through your chosen channel, about new products and offers to customers or registered users, always offering immediate, easy unsubscribe. To cancel registration or your account, email info@freedman.gr requesting deletion or amendment of the personal details held.
13. Value added tax
Under applicable rules and legislation, purchases made through this website are subject to VAT at the applicable rate.
14. Right of withdrawal
If acting as a consumer, you may withdraw without giving a reason within 14 calendar days, except in the cases described below where conditions apply. The period expires 14 calendar days after you or a designated third party other than the carrier obtains physical possession or control of the products; for an order containing several products, it runs from receipt of the last product.
The right applies only to products returned in exactly the condition received and does not cover made-to-order or clearly personalised goods, such as a made-to-measure suit. No refund is made if a product has been used after opening, is not in its delivered condition or has been damaged. You must exercise due care while products are in your possession and remain responsible for diminished value caused by handling that alters their nature, characteristics or functionality. Return products with or in their original packaging, together with instructions, accompanying documents and the delivery receipt.
To exercise withdrawal, email Freedman at the address in clause 2 and clearly state your decision. You may, but need not, use this form:
To: FREEDMAN ΜΠΑΚΑΒΟΣ ΧΡΗΣΤΟΣ ΒΙΟΤΕΧΝΙΑ ΕΝΔΥΜΑΤΩΝ, VAT 119764992, Tax Office Thessaloniki A, 92 Monastiriou Street, Thessaloniki 54627.
I hereby notify you that I withdraw from the purchase of the following goods:
Date of receipt: …
Consumer's name: …
Consumer's address: …
Contact telephone: …
Email address: …
Declarant: …
Sending your withdrawal notice before the period expires is sufficient. The right applies only to products returned in exactly the condition received. If you withdraw, we will refund all payments, including delivery to the original delivery address, without delay and within 14 days of being informed, except additional costs caused by choosing a delivery method other than the one offered by Freedman. No other refund fees apply. We use the original payment method. We may withhold reimbursement until all products are returned or you provide evidence of return, whichever occurs first. Dispatch within 14 days is considered timely. You bear direct return costs and remain responsible for any diminished product value arising during delivery, assessed by its nature, characteristics and functionality.
15. Returns and exchanges
For a return or exchange, contact us within 5 days of receipt at info@freedman.gr or 2310518734, Monday–Friday, 10:00–17:00. This option is independent of, and does not affect, statutory and contractual withdrawal rights. Freedman will process your request, reserve the replacement item and tell you which courier/transport company to use. Once approved, call that company to collect from your stated address. Do not use a courier of your own choice, as you will incur shipping costs.
Returns/exchanges are approved only for products in exactly the condition received, excluding made-to-order or clearly personalised goods such as a made-to-measure suit. No refund is made for products used after opening, changed from their delivered condition or damaged. Exercise due care while they are in your possession. You remain responsible for diminished value caused by handling that alters their nature, characteristics or functionality. Return products with or in their original packaging, instructions, accompanying documents and receipt. Refunds use the original payment method. You bear the return costs and risk described above. Contact us through any website contact method with questions.
For hygiene reasons, underwear, swimwear and socks cannot be returned or exchanged. Choose the size you normally wear. Reasons for return include a change of size, colour or design, a manufacturing defect, or receiving a different product from the one ordered. If the size or colour is wrong for you, request an exchange within 5 days of receipt without paying extra for the new item. This option is independent of statutory and contractual withdrawal rights. Follow the instructions above.
Defective products
If you believe a product does not conform to the Contract at delivery, contact us immediately, within 5 days of receipt, through a website contact method, describing the product and defect in detail. We will provide further instructions, examine the returned product carefully and email you within a reasonable period to say whether you qualify for a refund or replacement. Refund or replacement will occur as soon as possible and within 14 days of our confirmation email. For defective products, the full amount is refunded, including shipping and reasonable return costs, using the original payment method. Your statutory rights remain unaffected.
Orders from abroad
If ordering through this website from another EU member state outside Greece, the above return rules apply, except that you, rather than Freedman, bear return costs to a return location outside Greece.
16. Liability and disclaimer
Unless expressly stated otherwise and to the maximum extent permitted by law, our liability for a product purchased through the website is strictly limited to its purchase price. Because the website is open and errors may occur in storing and transmitting digital information, we do not guarantee the accuracy or security of information transmitted to or received from it, unless expressly stated. Product descriptions, information and material are provided “as is”, without further express or implied warranties beyond statutory warranties.
Products, particularly handcrafted products, may display natural material characteristics, such as variations in grain, texture, weave and colour. These are not defects or damage and should be expected and appreciated as part of the product's appearance. We select products of the highest quality, but natural characteristics are inherent. This clause does not affect consumer/user rights or withdrawal rights.
17. Intellectual property
All intellectual-property rights, trademarks and other rights in the website's material and content belong at all times to us or our licensors. You may use that material only to the extent expressly authorised by us or the relevant rights holders. This does not prevent use of the website as necessary to create a copy of an order.
18. Viruses, hacking and electronic crime
You must not misuse this website by knowingly introducing viruses, trojans, worms or other malicious or technologically harmful material. Do not attempt unauthorised access to the website, its server or any connected server, computer or database, or launch denial-of-service or distributed denial-of-service attacks. Such breaches may constitute criminal offences. We will report them to the competent authorities and cooperate to identify the offender. Your right to use the website ends immediately on such a breach.
We are not liable for loss or damage caused by denial-of-service attacks, viruses or other malicious or technologically harmful material affecting your computer, equipment, data or other material through using the website or downloading material from it or linked sites. Users are solely responsible for obtaining and maintaining telephone connections, computers and other equipment needed to use Freedman's services.
19. Links to other websites
Links and banners to third-party websites and resources are provided for information only. Their content is outside our control and their own terms apply, which users must read. Freedman accepts no liability for resulting loss or damage. Use of these links is at the user's own risk and intended only for adults.
20. Written communications
Applicable law requires some information or notices to be in writing. By using our website, you accept that communication will mainly be electronic, by email or website notices. For contractual purposes, you agree to this form and acknowledge that electronic notices, information and communications satisfy legal requirements for writing. Your statutory rights are unaffected.
21. Notices
Send notices to us through the website's available contact methods. Subject to the preceding notice provisions or otherwise stated terms, we may notify you by email or at the postal address provided when ordering. Notices are deemed served and received immediately on website publication, 24 hours after email, or three days after posting a letter. Proof is sufficient if a letter was correctly addressed, stamped and posted, or an email was sent to the recipient's stated address.
22. Transfer of rights and obligations
The Contract binds us both and our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of claims, rights or obligations arising from your transactions with Freedman without our prior written consent.
23. Force majeure
We are not liable for non-performance or delay caused by events beyond our reasonable control (“Force Majeure”). These include, without limitation: strikes, lockouts or other industrial action; civil unrest, rebellion, invasion, terrorist attack or threat, war or its threat/preparation; fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; inability to use railways, ships, aircraft, motor transport or other public/private transport; inability to use public/private telecommunications; government acts, decrees, laws, regulations or restrictions; and strikes, breakdowns or accidents affecting shipping, postal services or other transport. Our obligations are suspended for the event's duration and extended by an equivalent period. We will make reasonable efforts to end the event or find a solution allowing performance despite it.
24. Waiver
Failure to insist on strict performance of your obligations or to exercise a right or remedy under a Contract or these Terms is not a waiver or restriction of our rights and does not release you from compliance. Waiver of an individual claim does not waive similar future claims. No waiver is valid unless expressly stated as such and communicated in writing under the notices provisions.
25. Severability
If a competent authority finds any Terms invalid, illegal or unenforceable, they are separated to that extent from the remainder, which continues to apply to the fullest extent permitted by law.
26. Amendments
We reserve the right to revise and amend these Terms at any time. You are subject to the policies and Terms in force when using the website or ordering, unless a change is required by law or a government authority, in which case it may also apply to earlier orders.
27. Governing law and jurisdiction
Use of the website and Contracts for purchases through it are governed by Greek law. Disputes arising from or relating to use of the website or such Contracts are subject to the non-exclusive jurisdiction of the courts of Thessaloniki. If contracting as a consumer, this does not affect your statutory rights.
28. Amicable dispute resolution
If, as a consumer, you believe your rights have been infringed, send us your complaint through any website contact method. For transactions through this website, you may also use certified Alternative Dispute Resolution bodies listed in the relevant register under Joint Ministerial Decision 70330/2015.
